E. Lindsey Everson is a Partner with the Firm. Mr. Everson graduated cum laude
from the University of Houston Law Center and was Head Research Editor for the
Houston Journal of International Law. Mr. Everson went to work for the Firm as
a law student and was made partner in 2002.
Mr. Everson has a broad range of experience in civil litigation, in both state
and federal courts, and management employment advice work. Mr. Everson has
developed an extensive practice defending laboratories in regulated and
non-regulated circumstances, including NLCP advice work, CLIA requirements and
compliance, DOT drug testing of transportation industry workers in safety
sensitive positions, and state-law occupational drug testing claims. His
litigation experience also includes laboratory malpractice claims; insurance
coverage disputes; environmental litigation; personal injury cases; and
commercial disputes. Additionally, Mr. Everson has extensive appellate
experience, in both state and federal court.
Representation and advice on all types of employment issues, including Title
VII, FLSA, FMLA, ADEA, ADA, Workers’ Compensation retaliation claims, wrongful
discharge claims, development, implementation and handling of employment
policies and procedures, drug testing policies, OSHA compliance and retaliation
claims, and WARN notifications.
Practice before a variety of administrative agencies, including the Equal
Employment Opportunity Commission, Department of Labor, Texas Workforce
Commission. Extensive experience defending laboratories in regulated and
non-regulated circumstances. Detailed knowledge of Mandatory Guidelines for
Federal Workplace Drug Testing Programs and Health and Human Services
enforcement of drug testing regulation. Advice work in compliance with National
Laboratory Certification Program and CLIA. Representation and advice in
administrative hearings before ALJ in Department of Transportation revocation
proceedings and test challenges. Mr. Everson’s appellate experience includes
appeals in the Second, Fourth, Fifth, Sixth Circuit Courts of Appeal, and
having written a response to a Petition for Writ of Certiorari to the U.S.
Supreme Court, and experience in Tennessee and Texas appellate courts.
Experience in laboratory malpractice claims; insurance coverage disputes,
environmental litigation; personal injury cases; and commercial disputes,
including breach of contract, fraud, and Deceptive Trade Practices claims.
