D. Faye Caldwell is a founding member and is managing partner of the firm.
Prior to founding the firm, Ms. Caldwell was a partner with Holtzman &
Urquhart, P.C. Ms. Caldwell’s practice focuses on civil litigation and
management employment advice work. She has a particular emphasis practice in
employment matters and laboratory defense litigation. Ms. Caldwell is national
and regional trial counsel for a number of Fortune 500 companies in laboratory
defense litigation.
Ms. Caldwell also has a comprehensive background in business management and
over 15 years of experience in international business. She possesses a wealth
of business knowledge in addition to her legal expertise. Ms. Caldwell is a
member of the Women’s Business Enterprise Alliance and serves on the Board of
Directors for the WBEA. She is also a member of the River Oaks Women’s
Breakfast Club and Women’s President Organization.
Ms. Caldwell’s broad range of litigation experience includes a particular
emphasis in drug-testing law and management employment law. Ms. Caldwell is
national coordinating counsel for occupational drug testing litigation for one
of the nation's largest drug testing laboratories. Ms. Caldwell make
appearances across the nation in state and federal court to defend occupational
drug testing claims. Ms. Caldwell also provides extensive advice and
consultation services regarding compliance with National Laboratory
Certification Program guidelines to SAMHSA- certified laboratories.
She also regularly defends employers in state and federal court with regard to
employment discrimination cases under Title VII, the Fair Labor Standards Act,
the Americans with Disabilities Act, the Age discrimination in Employment Act,
the Texas Commission on Human Rights Act, the Texas Labor Code, as well as
other statutory and common law claims. Ms. Caldwell also regularly provides
legal representation to management other than litigation including audits of
employer compliance with state and federal workplace regulations, employer
representation in governmental investigations, and consultation on executive
compensation packages.
Ms. Caldwell has made appearances before a variety of administrative entities,
including the Equal Employment Opportunity Commission, the U.S. Department of
Labor, the Texas Workforce Commission, the Texas Commission on Human Rights,
the National Labor Relations Board, the State of Washington Employment Security
Department, and Administrative Law Judges of the U.S. Department of
Transportation and the National Transportation Safety Board.
Ms. Caldwell's litigation experience also involves general civil litigation
including contract disputes, fraud claims; nursing home and hospice litigation;
medical malpractice claims, insurance coverage disputes; product liability
claims; personal injury claims; and environmental litigation.
